Los Angeles-based POM Wonderful has petitioned the U.S. District Court of Appeals to challenge the Federal Trade Commission’s (FTC) opinion and order, which found the firm’s ads deceptive. At issue is a 2010 administrative complaint against the company in which FTC charged POM failed to substantiate health claims on its advertisements, including claims the juice and supplements could treat, prevent or reduce the risk of heart disease, prostate cancer and erectile dysfunction (see FCN Oct. 4, 2010, Page 17).
